Literature - Research Paper Example Barn Burning and Silence of the Lambs develop on the theme of good and evil and individual conscience through interactions between a powerful paternal figure and a younger pupil figure. Barn Burning is commonly considered a coming-of-age story, but the way that Sarty comes of age is precisely through the development of his own conscience and the hardest lesson that someone might learn: That their father is far from a good person. Meanwhile, in its own sense, Silence of the Lambsà is a coming-of-age story: A very young FBI agent is thrown into a very dangerous case and has to learn how to deal with serial killers, both investigating them and interacting with them. In both of these stories, the main characters are struggling to understand the true nature of their mentor: Sarty's father, Snopes, and Clarice's guide through the Buffalo Bill case, Hannibal Lecter. At the end of the story, Sarty sees that his father is going on an increasingly self-destructive path. His last attempt to b urn down a barn had succeeded and he had gotten away with it, but Snopes cannot help himself from responding to what he viewed as disrespect by again turning to the torch. Sarty knows he has to stop this imminent act of arson and escapes from his own family to do so, but as he runs, he tries to reconcile the monster he knows with the stories he's been told. ââ¬Å"My father, he thought. "He was brave!" he cried suddenly, aloud but not loud, no more than a whisper: "He was! He was in the war! He was in Colonel Sartoris' cav'ry!" not knowing that his father had gone to that war a private in the fine old European sense, wearing no uniform, admitting the authority of and giving fidelity to no man or army or flag, going to war as Malbrouck himself did: for booty - it meant nothing and less than nothing to him if it were enemy booty or his ownâ⬠. Sarty can't know Faulkner's omniscient narrator's aside here, but the information is important to confirm that Sarty's judgments about his father are right, that his instincts are correct: There is little redeeming in the character of Snopes. Similarly, Clarice goes into her discussions with Lecter knowing that he is a monster, but struggling to come to terms with his intellect and his strength of character. She never expected someone as refined, elegant and ultimately usually quite polite. Lecter respects strength, and repeatedly rewards her insistence with information; however, he despises weakness and a lack of independence, so he sometimes refuses to aid her more. In this respect, their relationship is truly that of parent and child: The child seeking more aid, the parent being careful with how much to dole out. The truly interesting element, however, is that Lecter is offering her moral advice. He gets at the core of her psychology: Like Sarty, Clarice once saw something in her childhood that she thought was unimaginably cruel, the bleating in panic and pain of lambs (a symbol of purity and sacrifice). Clarice's m otivations are to make sure she does not idly sit by again while something is butchered. The problem, though, is that Lecter's moral advice is not free and it comes from a truly questionable source. At every point, Clarice has to ask herself if Lecter is trying to get into her head to satisfy his own cravings or to advance a circuitous escape plot, or out of something resembling empathy or friendship. Practice of child labour in match box industries, glass bangle industries and is very commonly seen in cheap restaurants and dhabas etc. Generally speaking child labour can be said to be the exploitation or abuse of children in factories, industries etc, who are below the age specified by law working (mentally or physically) to earn for his/her own survival or to support his/her family partially or fully, and which prevents his/her social and education development may be said to be child labour. The reasons which are generally responsible for child labour may includeà [1]à : Poverty, Ignorance, Illiteracy, Population explosion, Lack of knowledge of their own rights, Big amounts of debt on the parents, Large size of family but not enough income to support such big family, Lack of social security scheme in the country, Weak enforcement of labour laws. According to an U.N.O report India has the maximum child labour in the world i.e. approx 20 per cent.à [2]à On the basis of Census 1991 and various governmental and non-governmental organizations following are the number of child labourers in Indiaà [3]à : Census 1991 2.63 crore, Organization research group, Baroda, 1994-95 4.44 crore, Centre for concern of Child Labour 10 crore. Extra-governmental volunteer organization more than 5 crore. The numbers may vary according to different organizations but the fact is clear that the numbers of child labourers in India are in crores, which is again a pathetic sight, especially with all the various child labour legislation and the Constitutional provisions. In a report by the Labour Ministry every 4th child is a child labour, aged between 5-14 years and there is one child labour in every three families.à [4]à But its not as if Indian governments havent done anything about this grave social stigma, over the years it has enacted many statutory legislations and Constitutional provisions in order to eradicate the problem of child labour, to name some of them, we have: Labour legislations: The Child Labour Act, 1986, The Factories Act, 1948, The Mines Act, 1952, The Right of Children to Free and Compulsory Education Act, 2009, The Minimum Wages Act, 1948, The Juvenile Justice (Care and Protection) of Children Act, 2000 Constitutional provisionsà [5]à : Article 24 provides: strictly prohibits children to work in hazardous environment. Article 21, 45 gives the right to education to all the children below the age of 14years. Article 39 declares the duty of the State to provide the children a free facilities to develop in conditions of freedom and dignity in a healthy manner. India is also a party to the United Nations Declaration on the Rights of the Child, 1959. India is also a signatory to: ILO Forced Labour Convention (No. 29); ILO Abolition of Forced Labour Convention (No. 105); UN Convention on the Rights of the Child (CRC). World Declaration on the Survival, Protection and Development of Children. The Government of India adopted the National Policy for Children (NPC) in August 1974. This Policy provided thatà [6]à It shall be the policy of the state to provide adequate service to children both before and after birth and through the period of their growth, to ensure their full physical, mental and social development. The State shall progressively increase the scope of such services so that, within a reasonable time, all children in the country enjoy optimum conditions for their balanced growth. Indian is also a party to United Nations Declaration on the Rights of the Child, 1959 and Convention on the Rights of the Child, 1992 and has formulated its labour laws in accordance to International Labour Conference resolution of 1979. The first part of the paper aims to look into the various legislations relating to child labour. In the second part we shall look into the various precedents set by the Supreme Court of India on the issue of child labour and finally the conclusion. Chapter 1 CONSTITUTIONLA AND STATUTORY PROVISIONS Constitutional provisions The government of India has enacted various labour laws has in accordance to International Labour Conference resolution of 1979. The Constitution of India, through various articles enshrined in the Fundamental Rights and the Directive Principles of State Policy, lays down that: Article 21 (A) The State shall provide free and compulsory education to all children of the age six to 14 years; Article 24 No child below the age of fourteen years shall be employed to work in any factory or mine or engaged in any other hazardous employment. The word hazardous employment in Art 24 also includes construction industry, also in P.N. v. U.O.Ià [7]à , it has been laid down that Art 24 is enforceable even in the absence of implementing legislations;à [8]à Article 39(e) States that the health and strength of workers, men and women, and the tender age of children are not abused and that citizens are not forced by economic necessity to enter avocations unsuited to their age or strength; Article 39(f) States that childhood and youth are protected against exploitation and against moral and material abandonmentà [9]à . Hence Art 39 in whole requires the state to ensure and protect the children and provide proper child care. Article 45 The State shall endeavour to provide, within a period of ten years from the commencement of this Constitution, for free and compulsory education for all children until they complete the age of fourteen years The framers of the Constitution imposed a duty on the State under Article 45 as one of the directive principles of the State Policy to provide free and compulsory education to all children until they complete the age of 14 year with the sole objective of completely eradicating illiteracy and child labour. Also many of the states had passed various Acts providing for free and compulsory primary or elementary education to children. But unfortunately years after the commencement of the Constitution the goal set by this Article which was to be achieved in 10 years, have yet not been reached. But the provision in article 39(f) and 45 of the constitution gave certain directions in providing a better quality of life of children employed in the factories. Labour legislations The Child Labour (Prohibition and Regulation) Act, 1986: The Act prohibits the employment of children below the age of 14 years in 13 occupations and 51 processes that are hazardous to the childrens lives and health listed in the Schedule to the Actà [10]à . The Factories Act, 1948: The Act completely prohibits children working below the age of 14 yearsà [11]à . It further states that if a child is between 15 and 18 years of age, can be employed in a factory only if he has a certificate of fitness granted with reference to him under section 69 which is in the custody of the manager of the factory. The Act also says that no child shall be employed or permitted to work, in any factory for more than four and a half hours in any day; The Mines Act, 1952: The Act prohibits the employment of children in mines, who have not completed their 15th year. The Juvenile Justice (Care and Protection) of Children Act, 2000: This Act was last amended in 2002 in conformity with the UN Convention on the Rights of the Child covers young persons below 18 years of age. Section 26 of this Act deals with the Exploitation of a Juvenile or Child Employee, and provides in relevant part, that whoever procures a juvenile or the child for the purpose of any hazardous employment and keeps him in bondage and withholds his earnings or uses such earning for his own purposes shall be punishable with imprisonment for a term which may extend to three years and shall also be liable for fine. The Right of Children to Free and Compulsory Education Act, 2009: The Act states that all children aged 6 to 14 years shall be provided free and compulsory education. It further states that all private schools should allocated 25 per cent of their seats for disadvantaged and differently abled children. Chapters 2 Precedents set by Supreme Court Though the government of India has enacted various labour legislations to prevent child labour still there are some contradiction among them, mainly the definitional debates on child labour as different legislation provide different definition of a child. Section 2(ii) of The Child Labour (Prohibition and Regulation) Act, 1986, defines child as a person who has not completed his fourteenth year of age; Section 2(c) of The Factories Act, 1948 defines child as a person who has not completed his fifteenth year of age; Section 2(e) of The Mines Act, 1952 defines child as a person who has not completed his fifteenth year; Section 2(c) of The Right of Children to Free and Compulsory Education Act, 2009, defines child as male or female child of the age of six to fourteen years; Section 2(k) of The Juvenile Justice (Care and Protection) of Children Act, 2000 defines child as a person who has not completed eighteenth year of age; Section 2(c) of The Plantations Labour Act, 1951 defines child as a person who has not completed his fourteenth year of age Hence, we can clearly observe that these legislation are at contradiction to each other in defining whos a child and setting an uniform age limit. Therefore the centre and respective state governments should set a uniform universal minimum age of the child as these contradictions adversely affect the objective of protection from child labour and providing a better educational and social development to children of India. Following are few of important Supreme Court cases that have helped in framing better laws regarding child labour: In Democratic Rights V. Union of Indiaà [12]à , it was contended that the Employment of Children Act, 1938 was not applicable in the matter of employment of children in construction works, as it was not mentioned in the act. But the court held even construction work is a hazardous employment and no child below the age of 14 years can be employed as given under Art 24 of the Indian Constitution, even though construction industry has not been specified in the schedule to the Employment of children Act, 1938, thus the SC rejected the contention. In Salal Hydro Project vs. Jammu and Kashmirà [13]à , the Court has restated the principle laid in Democratic Rights V. Union of Indiaà [14]à that Construction work is hazardous employment and any child below 14 cannot be employed in this work. In Sheela Barse and others vs Union of India and othersà [15]à , Bhagawati, C.J. quoted from National Policy for the welfare of Children incorporated to provide better social and educational development to the children of India : The Nations children a supremely important asset. Their nurture and solicitude are our responsibility. Childrens programme should find a prominent part in our national plans for the development of human resources, so that our children grow up to become robust citizens, physically fit, mentally alert and morally healthy, endowed with the skill and motivations needed by society. Equal opportunities for development to all children during the period of growth should be our aim, for this would serve our large purpose of reducing inequality and ensuring social justice. In M.C. Mehta v State of Tamil Nadu Orsà [16]à , the SC gave direction to the Union and state governments to identify all children and withdraw them from working in hazardous processes and occupations, and to provide them with free and proper education as incorporated into the Constitution, Artcle 21-A. The Court also directed the Union and state governments to set up a Child Labour Rehabilitation-cum-Welfare Fund using contributions from employers who breach the Child Labour Act. In Unnikrishnan v. State of Andhra Pradesh,à [17]à the SC held that every child has the right to free education till the age of 14 years. Artcle 21-A which was incorporated into the Constitution, reflects this standard. CONCLUSION It is said that child is the father of man, and the children of our country are our biggest asset. The government of India has enacted several laws in order to provide healthy social and educational environment for the children. But in spite of all the laws enacted, problem of child labour still persists in our Indian society that is because child labour laws are themselves flawed in some way or the other or suffer from poor implementation of programmes. Though awareness towards child labour has increased and now there are several NGOs trying their best, but today what we require is to take concrete actions, the central and respective state governments need to provide for better machinery for enforcing child labour laws. Unless this is achieved our country wont be completely free the burden of child labour.

Life of Maya Angelou Essay
Maya Angelou was born an African American. One would feel the agony she went through to be born as such and in America. Her grandmother was raped and bore a child; this child later came to be her mother. Similar to the ferocity her grandmother experienced, she was raped as a child by her motherââ¬â¢s boyfriend who was later on killed by her uncles. Because of this, she didnââ¬â¢t speak for almost six years afraid that her words had killed the man. This must be the dawn of her path to being a writer, realizing that words are powerful. If it could kill then it could give life as well. When her parents divorced, her grandmother took good care of her and her brother Bailey, Jr. and it was him who called her Maya. She became many things: a dancer, a cable car operator, a singer, a waitress, and where she flourished, a writer. The turn of her career came when she went to Egypt and Ghana. She went back to America to support Malcolm Xââ¬â¢s Organization of African American Unity but he was assassinated. The struggle of the race continued as she supported Martin Luther King, Jr. who was also assassinated defending the African American cause, this made Maya Angelou devastated. She never stopped working for the emancipation of the African Americans and continued writing for equal rights and liberty. And so, in 1993, she read ââ¬ËOn the Pulse of Morning,ââ¬â¢ at President William Jefferson Clintonââ¬â¢s inauguration at the White House. Her words are valuable to the nation. Her words influence men of power. Her life is interesting which produced works that are priceless to the American people most especially to the African Americans of whom she dedicated her efforts to for their emancipation. Angelouââ¬â¢s style of writing categorized her works in the genre of autobiographical fiction because of her writing styles in dialogues, characterization, development of theme, setting, plot and language. But for her, these are simply autobiographies. She speaks through her writing what she has learned or learning out of life. In her interview with Mike Schneider in Bloomberg TV, she talked to all women as her daughters for her book, ââ¬Å"Letter to My Daughterâ⬠. She speaks to them how a woman surpasses an incident in life as she would, given a similar situation. She writes to all the women as her daughters, sharing with them her story like she was one with them. In the poem, ââ¬Å"I Know Why the Caged Birds Singâ⬠, one would feel between the lines how an African American feels in the land called America. The words are simple and yet powerful in the sense that it deeply triggers emotions from the reader. These are deep sentiments of an enslaved race, wanting to be free but ââ¬Å"the birdââ¬â¢s wings are clippedâ⬠. Feelings of being held while the other birds are free: is something that she has undergone while the whites enjoy the liberty of being part of their race. A critic named Lupton, considered Angelouââ¬â¢s writings as autobiographies for they contain the elements of such: written by a single author, chronological, and they contain character, technique and them. Although, there are parts that are fictional, the elements necessary for an autobiography are present. Angelou has the tendency to go to the direction against the convention of what an autobiography is. She used the first person singular, ââ¬Å"Iâ⬠in talking about ââ¬Å"weâ⬠. She is placed among the African American autobiographists but other writers insist that she has created a different kind of interpretation of the autobiographical form. The book, ââ¬Å"I Know Why the Caged Bird Singsâ⬠, became an acclaim containing the sentiments of the black people. She wrote it out of a challenge by Robert Loomis, her editor, for her to write ââ¬Å"high artâ⬠. African American literature is more challenged in such that the authors have to agree about the status of their writings on whether itââ¬â¢s ââ¬Å"high artâ⬠. Oââ¬â¢Neale considers Angelouââ¬â¢s poetry a ââ¬Å"more expected ghetto expressivenessâ⬠and she also avoids a monolithic Black language. The bird was used as metaphor that is struggling to set itself free from its cage. The cage that incarcerates the creature represents ââ¬Å"oppressionâ⬠of the African American people. It must be emphasized as well that Angelou doesnââ¬â¢t intend to isolate the white people. She wanted to promote the relevance of diligence so as to change the concept of laziness among African Americans. At the latter part of the 1960s, one of her goals was to create a book that satisfied the criteria, ââ¬Å"organic unityâ⬠. According to English literature scholar Valerie Sayers, her poetry and prose are similar because of the episodes which are done like a series of short stories, but they do not follow a chronology of events. Her prose and poems are both in ââ¬Å"direct voiceâ⬠, which are characterized by steady rhythms with lyrical patterns that use figures of speech (similes and metaphors). Hagen has mentioned that Angelouââ¬â¢s works were influenced by the African American communityââ¬â¢s literary and oral tradition. She uses the ââ¬Å"bluesâ⬠music and literary characters in testifying about her life and hardships, with the use of metaphors, rhythms, and intonations. Angelouââ¬â¢s one of the most important themes are ââ¬Å"kinshipâ⬠, this has something to do with her parents abandonment of her and her brother, her relationship with her son, husbands and lovers all throughout her books. She discusses the value of family relationships of how it can affect development of a person. She spoke of her paternal grandmother who prophesied of her being a teacher when she intentionally went mute. Telling her that she would be a teacher someday but how could that happen if she does not speak. In most of her books, ââ¬Å"motherhoodâ⬠is predominantly manifested based on her experiences as a single mother, a daughter, and a granddaughter. Like in the book, ââ¬Å"Letter to My Daughterâ⬠, she dedicated this book to all women pondering on their life experiences. She delivered words of wisdom to soothe and give directions to their souls. When asked if she would say the same things to her son or sons, she said it would be different. She would never know how it is to be a man. If she would write something for her son/sons, it would be through the perspective of a woman. Her plot often surrounds in this motif ââ¬â mother & child. ââ¬Å"The woman who survives intact and happy must be at once tender and tough. â⬠ââ¬â Maya Angelou, Wouldnââ¬â¢t Take Nothing For My Journey Now (1994) She is an embodiment of strength and wisdom. This is where she gets her tenets from ââ¬â the experiences she has gained from childhood up to the present which molded her to become a woman whom people listen to. For Scholar Mary Burgher, African American women autobiographers have rejected the stereotyping of roles as ââ¬Å"breeder and matriarchâ⬠of their kind and they are being presented as ââ¬Å"creative and personally fulfillingâ⬠. Maya Angelou also wanted to deliver the message that women are more than the purpose of bringing forth children. Women are valuable beings in society as much as men are. In her books, women are winners and are brilliant who have overcome hindrances of racial discrimination. She has been influenced greatly by her relationship with her grandmother who died early in her third autobiography, ââ¬Å"Singinââ¬â¢ and Swinginââ¬â¢ and Gettingââ¬â¢ Merry Like Christmasâ⬠. Momma (Angelouââ¬â¢s grandmother), is quoted in the whole book. ââ¬Å"I write because I am a Black woman, listening attentively to her peopleâ⬠. Maya Angelou, 1984[87] She has greatly contributed to the emancipation of the black people in America working alongside with Malcom X and Martin Luther King, Jr. Went through devastation because of their deaths but continued on the struggle of her people. She continued to express the pains she goes through as a black woman through her music and poems. Using her gift in expressing through words her thoughts and struggles, unified the very same sentiments of all the black people in America. Her experiences especially from childhood gave her the foundation she needed to become who she is now. Everything that transpired in her life was a message she depicted in all her books. She resisted racial biases and protested outright to effect change in American society. She mentioned in her interviews when asked if she was angry, she said, ââ¬Å"I am angry but I am not bitterâ⬠¦Ã¢â¬ , reiterating that anger was necessary to express indignation to the unjust treatment towards the black people. She emphasized, however, that she is not bitter. There is a difference between those two. She used anger to advance the cause of African Americans but made sure there is no bitterness in her heart. Theyââ¬â¢re in every break of the game, every minute, every second. On this team, we fight for that inch. On this team, we tear ourselves and everyone else around us to pieces for that inch. We claw with our fingernails for that inch because we know when we add up all those inches thatââ¬â¢s gonna make the . . . difference between winning and losing! Between livin and dyin!
